SECOND AMENDED AND RESTATED RULES & REGULATIONS
OF KINGMAN ACRES CONDOMINIUM, INC.
- The walks, stairways, hallways, and other passages shall not be obstructed by an owner or his agents, servants, employees or guests or used by them for any purpose other than ingress or egress from the demised premises.
- No sign, advertisement, notice, or any similar device shall be inscribed, painted or engraved or affixed to any part of the outside or inside of said premises. A small engraved name plate not more than twelve (12) inches square may be attached to the outside door.
- Pets will be permitted to be kept in the apartments only in accordance with the following amendment dated 1/13/12. (Please follow the law! Pick up and dispose of your pet’s waste!)
- All pets must be registered with the Association. All pets occupying an apartment owner or tenant upon the effective date of this amendment will be permitted to remain provided such pets are registered with the Association within thirty (30) days of the effective date of this amendment. All pets acquired after the effective date of this amendment must comply with the provisions contained herein and must be registered with the Association within 10 days of acquisition.
- Apartment owners are permitted to have pets in an apartment in accordance with the provisions contained herein. Except as provided above, tenants or guests are not allowed to have a pet in the apartment.
- An apartment owner is allowed to maintain in an apartment one (1) pet provided it does not exceed 25 pounds or up to two (2) pets provided the combined weight of both pets does not exceed 25 pounds.
- Only pets of a domestic nature will be allowed such as dogs or cats. No exotic pets, snakes or other reptiles will be permitted.
- Dogs of a vicious temperament or breed such as Pit Bulls, Dobermans or Rottweilers will not be permitted.
- All pets must be properly licensed and inoculated as may be required by governmental laws and regulations. Proof of licensure and inoculation must be provided to the Association upon registration and annually thereafter. Additionally a veterinarian certification of the pet’s weight must be provided upon registration and annually thereafter.
- All pets must be kept indoors at all times and never be allowed to be outside of the apartment unless on a leash, confined in a cage or carried in the arms of the owner to his or her vehicle. No pet is permitted to be running loose on the common areas at any time. All excrements of a pet must be cleaned up and properly disposed of immediately.
- A pet is not allowed to be a nuisance to the neighbors either by odor, noise or otherwise.
- Each pet owner agrees to dispose of the pet if complaints are made and substantiated at a hearing of the Board of Directors. Complaints will be handled as follows: First complaint Owner will receive a warning. Second complaint Owner must appear before the Board of Directors. Third complaint Owner must remove the pet from the Condominium Property or move.
- Pianos, record players or other musical instruments shall not be played after 10:30 P.M. or before 8:00 A.M., unless the tone control is so lowered as to make the sound inaudible outside the demised premises.
- Waste and trash must be wrapped in bags or other containers and then placed in the special bins on the property. Recycled items must not be wrapped, but placed loosely in bins.
- Clotheslines, outdoor TV antennas, radio antennas, satellite dishes or window air conditioners may be installed upon prior written approval of the Board of Directors as to location, design, and landscaping. Notwithstanding the foregoing, satellite dishes and antennas for the reception of video programming less than one meter in diameter may be installed within the apartment or the limited common elements appurtenant to the apartment without prior approval of the Board of Directors.
- Storm shutters or porch enclosements will be allowed but must be standard type and color and approved by the Association.
- No alterations or additions to the exterior or structural interior of the apartment building, including shades, screens, enclosures, windows, doors, etc., shall be permitted without the prior approval of two-thirds vote of the owners and approved by the City of Stuart. Any alterations not installed in accordance with these rules must be corrected or removed at the owners expense.
- Each person shall be responsible to the Association for maintenance, repair and restoration of the black top or other parking surface in his or her parking space if such need for maintenance, repair, or restoration is caused by oil or gas leaking from his or her car.
- No child under thirteen (13) years of age shall be allowed in the pool until his or her parents have signed a waiver of liability for injury. No child under thirteen (13) years of age shall be allowed in the pool unless at all times accompanied by and under the supervision of a parent or guardian.No eating or drinking shall be allowed in the pool area.
- Personal conduct shall at all times be on a mature, restrained level. There shall be no shouting, arguing or other conduct disturbing to other owners or their guests. No alcoholic consumption, illegal drug use, or sports activities (organized, supervised, or otherwise) is permitted in the parking areas, roadway median, grassy areas between or behind apartment buildings or on roads within Kingman Acres Village I.
- No cars, passenger vans, motorcycles, boats, trucks, campers, motor coaches, unregistered automobiles, or any other vehicles will be allowed in any parking or street areas except as follows:Cars or Passenger vans that are within the following parameters:-Vehicles must have seats (front and back) within the enclosed design of the car or passenger van.
-Vehicles must have windows around the entire vehicle (front sides and rear).
-No more than 202 inches in length.
-No more than 78 inches in width.
-No more than 76 inches in height, including any racks, carriers, or
other attachments to the top of the vehicles.
The above requirements are not applicable to vehicles used by the handicapped.Pick-Up Trucks:Vehicle is no longer in length, width, and height than the dimensions given above allowed for passenger cars and passenger vans. Vehicle does not have painted names or logos, vehicle wraps, camouflage, murals, or any other type of display on any outside area of the vehicle. Manufacturer nameplates and vehicle design indication that has been adhered at time of manufacture, and is within the size limits displayed on all other vehicles will be permitted.
-No donks, low riders, hi-boys, ratrods, big wheelers, or any other
type of vehicle that has been modified from its manufactured form
will be permitted.
-Trucks may not be used for carrying commercial tools, equipment.
materials or debris. - All vehicles must have a Kingman Acres sticker or a guest pass.
